Aggravated burglary-non drug grid severity level 5. Is this considered a non person felony or a person felony? Also, what is the difference between the two?

The burglary was for breaking and entering. His younger brother was with him and he was underage so my friend was 18 so he got charged with Aggravated Burglary. (I don't know too much because this is my friend's situation.)
Nothing was stolen because they got caught.

In my experience (private security in Oregon, B.S. in Criminology and Criminal Justice) -- a "person" crime is that which is committed against a person: Murder, robbery, assault, etc.
A non-person crime is that which is committed against property: Theft, Burglary, Arson
A felony is defined as a crime for which punishment of one year or more in prison is authorized and are the more serious crimes that seriously affect a persons ability to secure employment, welfare benefits, voting rights, and many other things. If it's not a felony it must be a misdemeanor -- a crime for which the maximum available punishment is less than one year in jail.
If your friend is being charged with felony burglary it is a very serious offense and he should secure legal counsel immediately. All jurisdictions provide the right to an attorney, but there is usually a lot of paperwork that needs to be completed before the court will assign a public defender. This needs to be accomplished as soon as possible for the best representation.

This could be considered a property felony where there was no permission from the owner for the dudes to be there.
If someone was at the location, then an aggravated charge is tacked on because the burgalry is now considered life threatening. |
