My husband has just been fired from his job as a foreman/site supervisor on a construction site. He has been with this company for just over a year. A few months ago he received a pay rise (without asking, just following a very positive review). Today he is fired and told he doesn't 'fit' in their company. The company is quite large, he doesn't know the owners well, has only met them a couple of times. He works 80 hour weeks without complaint. The company has plenty of work on at the moment, it is not like he has been laid off due to no work. Can you fire someone like this? Does he have any recourse? Additional Details We live in Sydney, Australia

Most likely yes. As long as he is working in an at-will state (only montana is not) it is legal to fire someone for any reason, or no reason so long as it is not for some sort of discrimination.

They can fire him for any reason. They hire & they fire. Recourse, find another job. |

They can do what they want unless he can prove they did something wrong. Just working 80 hours doesn't mean much, there are a lot of other aspects to a job. |

Unless the real reason for the firing is unlawful (discrimination for example) and he can prove it, they can fire him for any reason. |

Unluckily, almost all of the US operates under the employment-at-will policy which states that anyone be can be fired for absolutely no reason at any time unless the firing is covered by a discrimination law (EEO, ADA, ADEA). Unless your husband can prove he was fired as a result of discrimination (age, race, ethnicity, etc.), there is not much he can do. |
