So 6 months ago I requested to my supervisor that I needed to step down to focus on my personal and family issues as I found out my mother had terminal cancer. Well, unfortunately I allowed him to talk me out of it and continued in my position as best I could while attempting to take a step back a few more times just to be talked in to staying. Last week I finally put my foot down and said enough is enough and requested the step down.
I had two choices which were to take a lesser position in the same department (this would allow my boss to utilize me in a lesser capacity in a tough market) or go into an entirely different department which would require no pay cut. Since informing him I wish to go into another department his treatment of me has been a 180 degree difference. He sat me down 2 days ago and berated me for 2 hours on all the things he wanted to address me for but did not because he thought I might step down if he caught me on the wrong day or mood. In addition, he is pulling things up that he has either never spoke to me about in the past or what I would consider minor in scope and making them a rather big deal. I now fear the last few weeks before I transition he will document me (this would prevent me by policy from going into another department) or even find a reason to fire me. I told him on several occasions I felt my performance has been lacking compared to previous years due to my situation but he always brushed this off by saying "75% of you is better than 100% of the other guys that work for me" What angers me the most is I have battled through the last 6months through personal anguish to receive this lack of support. What should I do? Can he do this?

If you own a degree - or any other qualification - then you'll already be in advace of of the masses when it comes to looking for vocations. Wow, some bosses can be such di*k heads.
I don't have a good answer for you, other than maybe approaching HIS superior and make a formal complaint.
