I took a few weeks off from my job (Burger King) because my bf was visiting me & i got sick. So they took the paychecks they owed me & sent them back to Miami where i guess the checks come from? They knew i was coming back to work soon though. So i called the BK company in Miami & they said theyre not sure & think my job lied because they cant find them. I need my checks NOW because i have bills to pay. Cant i sue them for that?? My bf said theyr not sposed to send them back to the company, They were supposed 2 send them to my house if anything. But they didnt. So what should i do?
I even spoke to some1 else who gave me the number to the SuperVisor but shes been ignoring the calls & not getting back to my messages. & now my BK job isnt answering their phones So i cant get in touch with ANYbody. =( What am i supposed to do now? Becuz i NEED my money. Additional Details They owe me 3 paychecks, all together totaling over $400.

you can sue them over that, for sure. that's not right. as long as it's over a matter of 20 dollars or more, you can sue. tough situation though... |

how do they owe you three paychecks?
do they pay weekly or bi-weekly?
your story does not make sense it would seem the most you could have is two checks depending on how the pay-periods and pay-days fell and when your last day worked was. you need to go in and speak with the general manager and they will explain the pay-policy it seems you may be a bit confused or mis-informed. |

You took a few weeks off? Was this vacation time and put in as such? You obviously are hourly so no worky, no payee. In other words it appeared that you quit. Do you have sick pay hours? Somehow I doubt it. |

Call your state labor department. If they are paying you for hours worked, and vacation time, then you are entitled to that money. The state labor department can investigate and if they find wrongdoing on Burger King's part, they can make them pay.
Go to the store and talk to your manager. You can't rely on phone calls to get something done. |

Call the store manager, or Human Resources, and politely explain the situation and that you haven't been able to get in touch with so-and-so (the supervisor) and politely quote the state or federal law that requires you to be paid for the time you work, or for them to send the checks to you, exc (you can find federal laws at the website of the Equal Oppurtunity Employment Commision, eeoc.gov, while state laws should be listed on your state's government website, such as Colorado.gov). Tell the store manager you're sure he or she can get the issue resolved, and repeat his or her name back to him or her. This tells the manager two things:
1. You know your rights under law
2. You know who you have spoken to
This will tell any manager with half a brain that unless he or she resolves the issue, he or she could have a lawsuit to deal with. Note you DID NOT say you'd sue, you just quoted the law. That is not a threat.
Make sure to write down everything you've done up to this point to get things resolved, and write down the date and time you made the call to someone higher-up. If that doesn't work, call Corporate and give the situation, then ask them point blank for the contact information of thier legal representation. Because the only reason you'd need to know that was if you'd already spoken to an attorney who wanted to send them a letter, that might just scare them into action. It worked for me when my old job took money out of my paycheck they weren't suppossed to. |

First off, do not worrying about sueing them. The amount of your checks is not going to cover the fees, time, etc, that you do for the case.
How much do the paychecks total? If it is less than $100.00 than just let it go, but if it is $100+ call BK on a daily basis demanding your paycheck. Go to your old job and demand your money back.
If you want feel free to call the Labor Board in your state and explain the situation. They may even be willing to handle your case for free, but you are going to have to prove that BK owes you that money. |

There is a federal law about this. You are owed the money and you can file a complaint with the government about it. Unfortunately you may not get it immediately. I had a previous employer "Forget" to send me 1 months' salary, plus a bunch of company-required expenses, so I'm familiar with this problem, and it is all too common.
The usual claim is 2.5 times the damages (arrears) so you might get more out of it. The thing is, they might have sent the checks back to corporate, because corporate is supposed to handle HR matters and things like that.
Personally I'd file the claim and see what happens. For me, I did not need the money immediately, so I sued instead and added some money on there for punitive damages, which I got. |
