I have been on probation working at a bank. And I had strep throat last thursday and I had to call in sick. I was originally off on wednesday and I was on vacation on friday. So my bosses think that I called in sick on thursday in order to have three straight days off for fun. They said that they will report this to corporate office, and they can fire me since I am still on probation. However, I provided doctor's note, a copy of my prescription and receipt. Well, they did not work, i guess. At the end, one of my boss said "IF strep was true, you are SO lucky for recovering from strep only three days! And you were totally fine the day before wednesday! how weird!" with mean face. She also told me that I should have came to work no matter how sick or contagious I was, and wait for somebody to let me go home or pass out(so I can go home with ambulance). Basically, they are calling me liar and trying to write me up. Is it appropriate for me to call hr and report them? Additional Details I thought doctor's note would have been fine. However, my boss is still reporting this issue to the corporate because they are still not clear about this absence. I have no idea what the corporate office will do to me though. Plus, they seem like they are not going to call the doctor's office or nothing which I do not understand why.

It isn't harrassment, and an employer does not have to excuse you for an absence even with a doctor's note. You can be disciplined for missing work even if you WERE sick. |

you have a legitimate complaint. Keep a record of all times where your colleagues do anything to belittle you or make you feel bad in any way. Do this over the course of 2 weeks then send a copy of the list to HR and tell them that unless they step in and rectify the situation you will approach a tribunal. Probation or not you still have rights, you just need to know how to use them and believe me, most employees have no idea. |

When I was in the work force I had a job I absolutely loved and that is rare, but while on probation, one of the supervisors wanted to give my job to a lady that was under me. I was an employee for the company but this lady actually worked through an agency to come to our job site. Anyway, I worked my butt off to get through the probation and looking for a raise to boot which I was told was coming until this one supervisor wrote me up one day for something I didn't do. We debated back and forth for a while until the point the following day he asked my own supervisor to fire me. I went over all of their head and went to the superintendent of all supers and employees and told him what had happened and his reply to me was, since I was on a probationary status, he could say anything he wanted to, to fire me even if he didn't like the way I combed my hair he could do that. As it turned out he guaranteed that the lady would not get my job. So I told him I was not trying to boot anyone from having a job, then he interrupted me, and said, I like the way you think, just know that she still will not get your job but she will get another job. |

HR my eye. Go ahead so you'll jump through all their hoops, but also get going on a case filed with your State's Labor Dept. (or equivalent), and maybe even the NLRB (National Labor Relations Board). Even probation does not cover firing for an unjust cause, and, although in most states they can fire you without cause, they themselves have opened the door of justification in this case. You may need an attorney specializing in unjust cause terminations (for a third of the settlement).If you win, you don't want reinstatement with a firm as rotten as this one--take the $$. |
