Is this harassment at work or no and what should i do?

A couple days ago i was working i was helping out a new employee type i am a pharmacy tech and the phone rang i was going to put it to ring to another phone but it hung up on the person on accident and the pharmacist came and pushed me 4 times almost pushing me over and i am a big guy and grabbed me and called me stupid, moron, idiot, and retarded. People have been telling me to get a lawyer to sue for harassment is that enough for that? Also this isn't his First time he did it before and he degrades me in front of other employees everyday. I have talked to the pharmacy manager about this and he told me he would talk to him but it hasn't worked

you find a lawyer that says they will file and win that case and i will pay the tab.

sounds like the pharmacist has little in the way of people skills but that assumes you have all the facts posted here. being rude, pushy and a bad supervisor is not grounds for a law suit. the pharmacy manager needs to address the issue and you need to bring it up again if need be but don't waste your time thinking you can gain anything through a law suit.

pushing a co-worker as described here does not rise to a criminal offense.

What your company does about your complaint depends on the quality of management and the policies they have on harassment. Obviously, they should take the appropriate actions to correct the situation, which would include training managers and disciplinary action.

Pushing you and a variety of other things including contact or the threat of physical contact is considered assault and battery and is not a complaint for the labor board. This is a complaint that should go to the local police department if you intend to pursue it. From what you describe, there was no intent to harm you physically, so it does not sound like a criminal complaint, but the incident is still illegal, and qualifies both as assault and as battery.

Quoting one of my linked sources, which define and give examples of battery, including pushing; "In the United States, the common law requires the contact for battery be "harmful or offensive". The offensiveness is measured against a 'reasonable person' standard." And another source below says, "offensive touching can constitute a battery even if it does not cause injury, and could not reasonably be expected to cause injury". What you describe certainly can be considered both assault and battery, which can be brought to the attention of your company, the police, and the courts, as you choose.

It's definitely demeaning and you should take this into legal action. That man is degrading you instead of doing his job and that is stupid. I hope you win in court :)

That is harassment, no one should be putting there hands on you. Especially at your job. Please find help.

I think it qualifies for harassment, but I know it is assault. You can have him arrested for assaulting you. Your employer is required by law to protect you from freaks like him.

Not just harassment, it is assault.
Since discussing it with the pharmacy manager hasn't worked, contact your labor board. Make certain that you have documentation of what was done and said, with dates and times wherever possible.
