Is this legal for a boss to do this?

the other week i forgot to clock out for a break at work so the boss took 30 minutes pay from me . is he allowed to do this as he couldnt prove i took a break?

yes, as breaks are not normally paid, so you would not have been paid in the first place, so he has the right to do so.

It depends on the state because states regulate meal breaks.

If it is mandated by the states for a meal breaks (such as California) and you have taken a meal break, the employer can recover the hours back.

So your situation can be legal.

Yes he is. If you actually did take the break he can deduct that time from your check. However, if you did not take the break and worked during this time it would not be legal and you could file a formal complaint against him the your states Department of Labor Wage & Hour division. 1-888-4US-WAGE.

if you took the break then yes. its your responsibility to make sure you clock out, if you weren't going to take the break you need to tell ur boss before hand and get it approved
