Is this legal for a business to do?

I just got hired at a car wash and lube place. I get paid 7 dollars an hour but they only pay us while we are working on a car. So when a car pulls up, we clock in and do our work on it, but as soon as there is not a car to work on, we have to clock out and wait on another one. So while I am getting paid at a rate of 7 dollars an hour, I am really making about three or four which is under minimum wage.

Is it legal for a company to do this or is this normal for a business like this? We stay at the store while no car is there and use up our time waiting on them, yet we are not getting paid.

No, not legal, you must be paid for the time you are required to be there, whether there is a car to work on or not.

No, it is not legal! If you are required to be on the premises, they must pay you the full wage. If they require you to be "on call" they must pay you a particular wage for that, as well.

Turn them in.

Clocking of an employee's time normally begins at the start of the work day followed by clocking in/out at lunch/dinner followed by clocking out at the end of the day. There is no such thing as clocking per session of cars that are worked on.

A check with your state labor board will confirm the above response.

As others posted this is not legal. As long as you are on the work premises and required to work from X time to X time you must be paid for this time unless you are on break. As Michr wrote. Immediately contact your state Department of Labor at 1-888-US-Wage.
