Is this right? should l have got paid? Please please help.?

l have been working in my work place for 3 years and real good to them always on time and turning up when poorly, but last monday l had to go home as l had the flu, l went to the doctor's and he signed me off for 3 days, saying l should be fine to go back on the thursday, which l was and did turn up at work, only to be told l`m not going to be paid for the days l was off, even though l showed them my sick note, so now l`ve lost £120, just for having the flu! is this right? if not what can l do about it? please help.

It is up to the individual company if you get paid when you are off sick.
The only thing they have to pay, by law, is Statutory sick Pay (SSP) but it is only payable from day 4 onwards.

If your employer gives sick time, then yes. If they don't, then no.

unfortunatly you do not get paid for the first three days you have off work, regardless if you have a sick note or not

It depends on whether your employer has sick policies. There are some employers out there that don't make allowances for people who are sick, so it would have to be out of your own pocket.

UK answer:

There are 2 types of sick pay:
1] Statutory sick pay [SSP]-you will not get this for the first 3 days of absence. This is paid by law from days 4 onwards.

2] Company sick pay-most larger employers have company sick pay. This is over and above SSP. Some smaller companies do not pay company sick pay. Your contract will tell you if you are entitled to company sick pay.

If your contract does not entitle you to company sick pay they are within their rights not to pay for 3 days.

Check your contract and your right to cmpany sick pay

It depends entirely on your company's policy of (what we call in the US) "sick pay."

Most US companies allow you a certain number of days during a year that you can be sick and still be paid.

I'd ask your Human Resources department what their policy is on "sick days" (or whatever term you use).

Some companies have a policy that you will be paid whilst off sick. You should check your employment contract or your employee handbook to find out if it is covered.

Otherwise, if your company doesn't have such a policy, then the law states that you may receive Statutory Sick Pay after three days' absence (i.e. you get paid from the fourth day onwards). It sounds like you were only off for three days so unfortunately you wouldn't be entitled to receive anything.

If you did not have any sick time then you do not get paid for it.

Sorry but really no one can answer your question without knowing what it says in your contract of employment regarding sick pay. In the UK you are entitled to statutory sick pay though that is no where near your earning level. Unfortunately this is not paid for the first 3 days of any one period of sickness so you do not qualify for that. It sounds as if your company does not have a company sick pay policy. It certainly seems hard after 3 years service. Incidentally, being on time is not being "real good" to them it is a requirement of your employment.

You should talk to your line manager or HR Manager and get clarification of what - if any - their sick pay policy is. Most people are sick now and then (apart from my father, me and my son, my father and i have never been sick, ever, and my 26 year old son is, so far, following that lucky trend).
