Isn't this Illegal?!?

Last week the head of HR of my company noticed I left for 1 hour and came back due to a tip from an agent in my department. Now, I was approved to remain clocked in by my supervisor to leave work for 1 hour on Friday to go to class-which is what I was doing. Come Monday, I asked my supervisor why my hours were short-he noticed I had punched out for my class and asked me about it, I said I did not punch out as he told me not to. So he then proceeded to fix my hours.

Well, as he submitted payroll later on, he noticed someone had changed my hours again to where I was punched out for 1 hour- the hour I was gone for class. Later we found out that the head of HR changed my hours and when it was explained to her why I was leaving and that I was approved for this, she apologized, but did not change my hours back, and I lost out on 2 hours that day (because of the break in schedule it took out the hour, and 2 half hour lunches. Not only that, but as a manager at my job I am required to do the closing report which usually takes 15-20 minutes to do. So that day, instead of me punching out at 11:22, I was punched out at 11 by HR as well, so I also lost out on 22 minutes there.
Was it legal for the head of HR at my company, according to NYS laws to alter my hours without consulting me or my supervisor first?

The thing is, for me to leave for one full hour and remained clocked in for it, I combined my breaks together. The half hour that is deducted normally, and the 2 fifteen minute breaks I am entitled to, which are both paid breaks. I was given permission by my supervisor to combine these breaks together and use it to go to class.

Changing your time from 11:22 to 11:00 is definitely not legal.

Your HR manager may be concerned about having you clocked in during travel time. Generally travel time to a class is not included, although class time is included in pay since your manager approved. It can be a liability to the company to have you clocked in while traveling.

I agree with some of the other posters that you need to go to someone above HR's head here, or ask your supervisor to intervene. She cannot alter your time when you actually were working.

I'm not sure it's illegal. But it is certainly bad policy. If an issue is brought up about your work hours, it should have been discussed with your supervisor first. I think you should go back once again to get this permanently changed and all appropriate work hours accounted for. You should not have to suffer a financial loss due to an over zealous HR manager.

If your supervisor approved you leaving, then there should not be a problem. If the HR department has a problem with it, it should be taken up with your supervisor. I would approach head of HR again about the situation and demand that they change it. If that doesn't work, I would go above their head and talk to the head of the company.

Actually, I don't think it's legal for your supervisor to give you permission to leave work and still remain clocked in. I think it's the head of HR who's acting legally, and your supervisor who's acting illegally.
