I worked for a company who had 2 owners, one owner fired the other one and took over the buisness. He made everyone sign non compete contracts so we wont work for the other person when he opens his own buisness up. I refused because he wouldnt explain the contract, a week later I was told I was being laid off because it was getting to the slow months. I had some words with the boss and left, then he denied my unemployment claiming I was fired for faults of my own which was a complete lie, what can I do?

A non complete contract? I go to law school, a contract requires 6 elements: Offer, acceptance (by offeree), consideration, legality, capacity, and contract intent (aka mutual assent). When you say non-complete what exactly do you mean? There needs to be an offer, you need to accept it, the consideration is forebarence which means he wants you to not work for this other guy, it needs to be legal, you's both need to be of age and of sane mental capacity, and there needs to be intent of a binding contract. I'm pretty sure he can't make you sign that just to have you work for him just so that you won't go work for this other guy. You could call a lawyer and schedule a meeting and chat. He'd be better able to explain everything to you. Good luck |

You can appeal the decision but since you chose not to sign the non compete companies can choose not to follow through with employment. |
