my brother has had the same job for 7 years, he manages condos. Anyway the board just elected a new president and she has a personal vendetta against my brother. He recently hurt his back and is on workman's comp, yet she keeps calling him, sending him letters, ect saying if he doesn't do this this and this he will be terminated. One of the things is to sign a contract ( as he was under a verbal one before). i was just wondering if this is legal. Can your employer force you to sign a contract while on workmans comp? any other help would also be appreciated.
=) Additional Details he is discussing it with a lawyer. i am just curious =)

I take it this is a contractual agreement regarding employment, not regarding the WC...and actually, no, she cannot force this upon him while he's off injured. Obviously, she's trying to protect her own interest...someone hired him verbally, there was never a binding written agreement regarding the employment and now she's looking to protect her butt. He shouldn't sign a thing but should seek counsel from a competent Labor Lawyer.
He can then ask for this agreement she wants signed, take it to the lawyer and have him either justify or dismiss the contents as being in your brother's best interest. I am pretty certain there is something within it that relates to a) injury on the job and/or b) any sort of coverage for such or that stipulates that the company can let him go if he is unable to perform his duties within x number of weeks/months from the date of injury...all absolutely not kosher!
Good luck to him, he has enough of a fight with WC...he doesn't need the employer added to the mix. If he's been dedicated, after 7 years, he deserves some form of support and respect. |
