Labor Law. Last Payroll. Salaried Employee. Short Check?

I recently resigned from a position because my boss was not trained in operations, as he had come from sales. He would just shoot into town, get everyone drunk, tell some dirty jokes and shoot off again . He made promises to people which made it near impossible to manage him. Simply, he did not have my back, but sought often to go behind it.

My last payroll check was calculated out to the day. I have never heard anywhere where this is done. It has always been in my experience that a salaried employee receives his total compensation for the entire payroll period and not pere the number of days he was employed during that payroll period.

Is anyone familiar with Tennessee Labor Law as pertains to final payroll for salaried employees? Can a salaried employee be paid calculated as a perecentage of the number of days he was employed during the final payroll period?

An exempt employee only needs to be paid for time worked during the first and last week of employment.

The day you quit is the last day you are required to be paid.

I don't know what the laws are, but the labor board definitely will understand your issues and if you have a case. They might also be able to help you with unemployment compensation.

Absolutely. You have no reason to expect to be paid til the end of the month, for example, if you quit in the middle. A salaried employee is always paid dependent on a number of base hours worked. If your salary is based on a forty hour work week, then you can be docked for anything less than forty hours, depending on the terms of your contract.

If you don't have a contract, then you are a de facto hourly employee that gets screwed out of overtime on a regular basis.

Either way, your pay can and should be prorated to the actual number of days worked in that pay period.

If it were me, I would expect to be paid only for time worked.

You resigned...you quit. Be happy you got a paycheck calculated to the day. Do you want something you didn't earn? If you got laid off or something..then you can throw a hissy fit., but you quit...so shut up...they don't owe you anything Toots
