A landlord or his agent cannot take away a facility or amenity that the tenant has enjoyed the use of during the period of the said tenancy......Are there any legal persons out there who can confirm this for me ...I would really appreciate a concrete answer. Fred lloyd.

Unless the amenity in question is included in the lease, yes they can take it away, like if you're talking about closing the pool or a rec room or something like that. |

Landlord/tenant laws very widely by state, but in my state WA we can. An amenity is just that, an amenity. "something that conduces to comfort, convenience, or enjoyment" It is not part of your rent. You rent the living area of your apartment, not the amenities. Especially if there are good reasons thing are taken away, such as needing repaired or they are damaged the owner has the right to protect himself from lawsuits. |

The landlord can give or take any amenity he wishes if its not written into the lease. |
