Legal action against not getting paid on time by the company i work for?

5 days in the past 5 weeks my company has missed and I have had to wait an additional 2 weeks to get. I was informed today when I talked to my HR office that I will have to wait till next pay to get the 2 days they missed to pay me for today. Is there anything I can do against this company? After talking with several other people I work with this happens all the time, Im not one to roll over and take it, I worked for it, I want my money!

Contact your local EEOC office. Google it, use google search engine type EEOC/state <your state. These people can help you with any job issue.

They are Equal Employment Opportunity Commission.

You need to check with your state's Department of Labor, wage and hour division, about the rules on paydays for your state. As long as your employer is eventually paying for the time worked, you likely won't get anyone to do anything legally, but it's worth checking.

You might want to start looking for employment elsewhere in the meantime. Sounds like this company might not have the funds to properly pay employees.

EEOC does not handle wage issues. You need to contact your local office of wage and labor and file a claim with them for unpaid wages. Have you asked your HR office why this keeps happening and what you can do to make sure it stops and you get paid for all days/time worked on time? I would at least ask them to hear what they tell you, then if there is no reasonable answer from them I would go and file a claim against the company.

It is an Employment Standard that you must be paid for hours worked within a certain period of time.

In Canada we have Employment Standards to call. Find out what the Labour Relations/Employment Standards is in your area and call them. Don't take the answer given as the way it is.

I agree with hr4me. Ask them if there's something you can do to help prevent it, because it just can't happen again. That should get the point across without being a threat. You can also check the law in your state. In my state, the law requires employers to pay wages due employees within 48 hours after separation or the next regular payday, not to exceed 30 days.

its your money and you earned it..it is against the law call the labor board and get a lawyer....i went through the same thing start looking for a new job b/c that company is about to go under....don't put up with are they will do it to you everytime!!
