im hopping some one can help me with this problem of mine.
My oldest daughter was diagnosed with MS, and I took a family leave act for three month's to be with her while she was in the hospital, I recently went back to work after my daughter had stabilized, on my first day back I came down with pneumonia, and i was forced to take 4 days off, the manager of the bakery knew of my condition before hand since I ed him to update him on condition, now the store manager is thretthreateningire me everyday that she see's me since i have returend to work, I am also taking medication that is enabling me to work but it is not ridding me of my pneumonia

It really depends on your boss's reasons for threatening to fire you. Since you already took over three months off, you have exhausted your FMLA time (assuming you were eligible for FMLA in the first time.) Therefore, if you keep missing work, your boss is not required to hold your job for you. If he's threatening to fire you for performance issues, and he can show proof that your performance is not acceptable, then there's nothing you can do. If you feel he is retaliating against you for taking time off then you could sue him, but be careful because it can be very hard to prove that somebody's actions are retaliation. |
