Legal advice on rights to renters in Utah, regarding apartments, flooding, and lease obligations. ?

I currently live in an apartment in the SL Valley. Every time it rains the floor of the master bedroom floods. The apartment flooded all last winter and management claims they thought the problem was fixed this spring though nothing was done to the apartment to suggest this would be the case. We moved in to the apartment in June and the apartment has now flooded twice since we have been here.    We have written letters after both occurrences. The first time it took them three days to even acknowledge the situation and another three days to do anything to dry out the carpet. During this last occurrence, the letter was turned in and they waited until the following day, after noon, to call and confirm the carpet was flooded before even notifying maintenance. Fixing the problem now consists of them leaving a giant fan in the apartment for a few days until the carpet is dry and then they inform us that the issue has been resolved.    We are now trying to figure out which direction to go to solve the issue and move out. There are currently three months left on the lease or the possibility of a $1200 buy-out. If we decide to go with the buy-out we would still be held responsible for November's rent. We would prefer to not be responsible for either due to a preexisting problem which does not fulfill the lease agreement and inconveniences us. Plus, it smells really terrible.

I'm pretty sure Utah doesn't have a residential tenancies tribunal for renters, but you can report them to the Utah government for being a bad landlord.

I would also call the property standards or residential tenancy inspectors in your town, especially if you see any mould issues or rot. Not all towns have a residential property standards inspector, but if yours does, call them - they can issue orders to repair, and can fine landlords who don't comply.
