My fiance' found out he had a son when the boy was 3. (My fiance's age at the time was 25.) They went to court, the girl asked him to sign over his rights as she wanted her husband to adopt the child. He did not. He pays child support mothly, with about 4,000 in back support and has been doing so for 3 years. He told them in court he's not signing his rights away until the man adopts the boy. Now, he's paying monthly on a child he's never seen. He recently got in touch with the girl to tell her she needs to have her husband adopt or let him see his son. He told her he would go back to court to gain visitation. Again, they are asking that he sign away his rights, and he's not doing it. He thinks he's not even allowed to with back support owed, and he's probably right, don't you think? So it's on them, right? If they want the child to keep thinking this guy is the dad then they need to adopt. He either A. wants to see his son, OR B. wants to not pay anymore... Any Advice... I really don't know what to tell him...

1. Get a lawyer.
2. I'm no expert, but I don't think the other guy can adopt the kid before your fiance ends his rights. |

He has to sign his rights away before the other can adopt. He needs to get it in writing that she is willing to drop all back child support and any future child support. But the other guy can not adopt if there is a father. |
