Legal help needed asap?

Like 6 months ago I let one of my friends borrow like $200 dollars worth of my sons clothes because her and her husband were having financial problems and couldn't afford any. When she borrowed them it was under the condition that she return them in a month or two when she was able to afford some clothing on her own. Well now she decided that she doesn't want to return them and won't answer my phone calls, e-mails, or anything. So is there any legal action I can take to get my sons clothes back? The whole reason I want them is because some have sentimental value and I'm expecting another son soon.

you can not place a dollar value on the sentimental aspect of the clothing which means all you could sue for is the actual value of USED children's clothes.
you are talking 5 to 10 cents on the dollar...........

IF you could win, which is very questionable there would be the problem of collecting on a judgment. If you lose you must pay all the cost involved. filing even in small claims court is not free, there is a filing fee, service fees etcetera and if you don't win you are out those bucks as well.

is it worth the aggravation and all the time involved?
learn from this and move on, your baby is going to need your focus to be on him not what some "friend" did to you.

Hi Ashley I dont think there is a whole lot you can do at this point just write the clothes off as a sentimental loss and learn from this experience not to lend things that matter. If I were you I would not speak to that person again. You should be able to trust friends if you cant you need to get rid of them..... out of your life GOODLUCK!

you can write a demand letter to formalize your claim. later, you could complain or file report with the police. its a verbal understanding but it is still a valid claim

legally, no. unless u have some sort of signed agreement on paper, i cant think of any court that will allow this case. since it was an oral agreement, find someone who knew about it to back u up. although, that would be a stretch bc oral agreements are hard to define in courts

Small claims court is the only way to go. You could try one of the ones on tv...

I would presume that you could probably kiss the clothes goodbye though.

If you have requested the clothes back in writing and your friend had refused or ignored the letter demand you can sue her in small claims court for the value of the clothes.

Just the fact that you file the suit may cause her to reconsider and return the clothes. If not, you can recover the value as well as the costs of filing the suit.

You can file in small claims court for about 35.00 and the fees for process server/sheriff or you can make a police report and they may stop by her house to investigate . I don't know if it's worth it to you, you will need to have witnesses that are willing to testify or get her to admit it in court. The ultimate problem with small claims will be getting the money after you've won a judgement, this takes a lot of hassle and time, but if you're willing, the courts can be an option.

Take her to small claims court, keep the emails that you have been sending her and get copies of your phone records from the phone company. Also, take anything else that will help prove your case in court. Good Luck...
