Legal inheritance?

My mother who was married to my father divorced when I was a baby. I never knew him. I have a half brother when my father re-married. I learnt a year or so ago, my father died and my half brother inherited all his estate, do I have a claim?

You do not have a claim unless:-
1. You are in Scotland (as the law is different to England)
2. you were financially dependent upon your father.

Presuming that neither applies to you then unfortunately you do not have a claim and your father was free to leave his estate to whoever he liked. As previously stated his will is a public document if probate was sought and granted. Check with the probate registry in the area he died to get a copy f you want to know what was said!

The will is a public document and I would get a copy of it if it wwent through probate, just in case yopu have a case in fraud . You may have a claim if you are dependant on him say in full time education but will disputes often cost more than the amount involved

check the state laws and file a claim! asap! you can always challenge the will if your not on it and say he lacked testamentary capacity for leaving you out. he would have to at least list you and leave you a buck or so. get a copy of his will. file a claim. in AZ you have 2 years to file a claim. each state could vary- but AZ is where i am in a probate suit.

If your father left a will and you were not named in it, probably not, however if he did not leave a will you need to go the Courthouse in that state and get copies of the paperwork. They would have had to do a publication of heirs. If the new wife knew that you existed (most of the time they do) and you were not named as a heir you could contest the administration. You need to check the probate laws in that state.
