Legal question. Does this make sense? My daughter was accused by a store of stealing a $2drink bottle.?

The store security stated it must have been her or her friend. She did not take it. They said they have a tape. As well as the bottle with finger prints. My daughter requested the police be called as she was sure when the tape was reviewed the misunderstanding would be cleared. NOT a ticket was issued, lawyer hired, they went to court, the bottle and tape have disappeared, now they are going to trial. It is her word against the store manger now. I do not think her lawyer is telling her what to expect. She does not want anything on her record as this could interfere with employment. She really did not take the item. What is the worst thing that could happen with a minor case like this. I have never heard of a trial over a $2 item. It seems to me that it is ridiculous that something like this could go this far. Could she go to jail over this? What should she be prepared for, again I don't think he lawyer is preparing her For this.

This is ridiculous if they do not evidence to back this up well I would suggest you sue them for ''deformation of character''. They have put her in an embrassing situation & accussed her of taking something that she didn't pay for! Whether she did or did not with no evidence to suggest she did I was certainly bring this further there are meassures on how to deal with situations and sadly yours has been dealt with in the most appalling way. Go further how dare they accuse her of theft with no evidence - how will this effect her in future? confidence issues/lack of trust etc its humliating for sure I would stick to my guns with this one!! and get rid of her lawyer this case should never go near the courts or a ticket been issued in the first place

I find it hard to believe that the police just lost the evidence. To me this whole question sounds like a bunch of bull.

First off if you can prove that your daughter wasn't at that store she is off the hook. If the police lost the tape and the bottle have disappeared the police need to find it. If the fingerprints on the bottle aren't your daughters then the store manager is in for it. I agree that there shouldn't be a trial over a $2 bottle it is just costing the store money.

Also the store manager is going to be apologizing a lot if your daughter is found not guilty because he has put her though a situation that can scare and embarrass her. Tell the lawyer that your daughter has the right to know what to expect.
