ok i will try again. I live in California can BadBoy BailBonds garnish my wages due to the fact that i cosigned bailing a friend out and now they arent making payments?

You might ask the bail bondsman about an affidavit to go off bond. Some states allow the bondsman to file this with the courts for non payment. If they do this, a warrant will be issued for your friend, but you will no longer be responsible for the payments. |

Nobody can garnish your wages without a court order. Of course, the court will issue such an order without a problem in this situation. |

Even though the Bail Bondsmen may have a written cosigned agreement by you for your friend and they want to collect any deficiency remaining on the bond, they have to go through a formal legal procedure in order to obtain a written summary judgment which then becomes a form of garnishment against your wages. However, the actual amount is merely a percentage of your wages and hopefully, your wages are so low that there's not much left in your wages to garnish. Again, if you threaten the Bail Bondsman by stating the simple fact, that there's nothing to be gained by attempting to garnish your wage since you can easily quit the job and ultimately, no one gets any income to pay off any debts whatsoever. They will likely step back and not press going after you and concentrate on your friend's delinquent payments, even to the extent of placing a lien on any personal property, like his car, his motorcycle, or real estate.
In any future transaction, where you are asked to co-sign for anyone, make sure that the primary obligator is someone you can trust to pay off the obligations in a timely manner.

If you cosigned, then you're responsible for paying if your friend doesn't. Since your friend is not paying, you must pay. Either that, or BadBoy can and will come after you. |
