I am lending someone money and will (hope) to collect it in May. This is my roommate and not a friend but I am doing it to keep the peace and i feel as long as i have a contract i will be free and clear. What are the exact words i need to have in a contract in order to get this money back in May without losing out.
Does the person receiving the funds need to write the contract or am i able to write it and just have him sign it? Besides the words "I promise to pay", today's date, the received date of the funds, and amount, what else should i include in this contract? Thanks in advance for your input

This money is a loan that will be repaid by _______________________________________(... or I will pay ____________Percent Interest until this loan is paid off. If I do not repay this loan of ___________(amount) I will pay all court costs and legal fees needed to collect this loan.

(You might want to change the interest part. Don't know if you are charging he/she interest on the loan from the beginning or not. Don't know the amount of money you are talking about. If it is a lot of money, I would visit a bank or realty office and for a small fee have it notarized. Give the borrower a copy for their files. Good luck). |

A contract just means you can prove he owes you the money, it doesn't mean you get it if he doesn't hsve it, or claims not to. |
