You might get somewhere with that lawsuit if you live in California but no where else will it fly. Companies can and do have dress codes... a part of that is being clean... the only lawsuits that have ever been won from BO were from bums that weren't allowed on public buses... and I believe it was in the good old nut state of California... |

Nope, most companies expect their employees to practice some kind of hygiene. Unless there is some documented medical reason for the BO I'd leave that lawsuit for another day. Don't throw good money after bad. |

If there is any defamation of character it sounds like it might be coming from yourself. B.O. is controlable by either taking a bath or using a deodorant. I worked with a girl who refused to use a deodorant. No reason, she just said it was nobody business how she smelled. She got canned. You asked. |

No. In fact I have had to discuss this thing with employees before. If the employee failed to "clean up" he/she was written up and eventually fired. Couldn't have customers complaining about an employee smelling. |

strictly a personal hygiene issue, this comes up often and I have fired people for it, it is not a disability |

Definitely not defamation of character, but terminations for BO is a gray area. As others have pointed out, BO is not a disability. However, if it is related to a disability, then disability discrimination may be a viable claim. Similarly, BO issues have also been raised in cases of racial and national origin discrimination. The context of how the "BO issue" was discussed can be very important. |
