My husband lost is job a months ago after the collapse of AHM , and now is having a hard time finding work in his field , so in the meanwhile he has no choice but to work in anything he can find until things work out .He found a job 7 months ago and has been working there , but the issue we are having is the way this company handle workers, and pay.
When he first started the lady at the interview did say it was a full time job , and that is what he was looking for , but this never happen they gave him 15 hours a week and makes about 95 dollars a week (my husband is having a hard time accepting the fact that he use to make about 3500 a week in his old one as an IT guy )so to go back to subject , is it legal what they are doing ? he work at night 3 days a week from 1am to 5 am , no benefits for our family because the lady said he is not working full time and it was her that said she would give him more hours after he has been 3 months with the job , so far nothing , not long ago 2 workers left for another job and we thought she would give more hours to him finally but instead she hired 3 more workers, the thing is they have many workers at night but it's like they split the hours between the workers , like 15 hours a week for each worker , meaning more work force for a little pay for each so the company is winning big ,work done well and fast by many workers without having to have a big payroll , and one of those new worker is working 35 hours a week and he just started compare to my husband and many other worker, how can they expect for someone to have a living on a 95 a week when you are an adult and have a family ? and when my husband ask her again for more hours she said that the company can't give more hours cause they don't want to pay extra , the other day he had an issue with her because she said that the work he was suppose to do that day it's suppose to be done in 2 hours , so when my husband did his best for it even tough it was kind of not normal for any worker to do the job in 2 hours he did , as soon as he finished she told him good job ,that he was done for the night, and he was schedule 1 to 5 .Is this legal ?

Warning: I am going to be brutally blunt. I am assuming that you live in a "right to work" area, where you have the "right to work" -- but no right to work under contract.
If the "promises" your husband were given are not in the form of a written contract, signed by an authorized representative of the company, there is only one thing you might be able to do about it.
Unfortunately, there is nothing illegal about subtle tactics to make the work environment "hell" for any employee the "boss" really doesn't want around. By "subtle", I mean doing things like giving a worker the "dirty" jobs or cutting their hours (or simply not scheduling the hours to begin with). Such tactics are designed to "encourage" the employee to walk out.
That one thing I mentioned earlier -- and this is a huge "maybe" -- is to prove that your husband is being deliberately discriminated against. Good luck with that. No matter how it turns out, it's going to be extremely expensive.
Your husband needs to start looking for another job, and he needs to start looking right now. |

A lot of companies do this, in fact one of the largest company in the USA does this. Promise 40 hours but keep all employees under 40 so they don't have to pay benefits. They save money and I will admit they do pass some of the savings on to their customers.
You should just be thankful he has a job....If he is good he will find another job. |
