Maryland IT Company Not Paying H1B's?

I am working for a very corrupt IT company (trying to get out) in Maryland. I've only been there a few weeks (I am an IT Recruiter), and have since learned this comapny hires H1B's, brings them here to be in RECRUITING roles for the company, and does NOT pay them at all!!! Can I make a confidential report to the INS?? To make matters worse, this company services the Fed Gov't - mostly DOD...they also partner quite a bit with EDS. Im sure if DOD, EDS, etc. learned what this co. is really doing they would terminate all working contracts with them, etc.
I could use some good advice. I'd like to see them shut down.

Let me understand this because I too worked for an IT company in NYC as the HR Director. The company hires individuals with H1-B visas and they do not pay them? You mean they do not get a salary or they do not pay for there sponsorship? I find it hard to believe they are not being paid a salary. If this is the case you would report them to the State Department of Labor Wage & Hour Division. If you mean they are not paying for there sponsorship they are under no obligation to do this unless it is part of there contract with the Federal Government. At the company I worked for we did not pay for there sponsorship. We sponsored them yes. But we didn't pay for the paperwork or attorney's fees if any. Now if you are saying these individuals are being promised roles in IT and placed as recruiters instead they can easily quit. It is the employer's responsibility to discuss with the foreign national whether the company OR the applicant will be responsible for the INS filing fees, costs, and legal fees incurred when seeking a work visa or green card. Given that the expenses can be substantial, if the employer is considering offering to pay for these expenses, the employer must weigh the value that the foreign national will provide to the company versus the financial commitment. So your company is not paying for H1-B visas? Again, they are breaking no laws unless they promised they would pay these expenses or it is part of the government contracts your company incurs these expenses OR these individuals are to be brought in to do specific technical work and being used as recruiters. In fact, they would be in serious trouble for hiring H1-B'ers to be IT recruiters. The employer needs to prove that they tried every possible outlet to hire an American for the position, but were unable to find a qualified candidate. IT recruiters are all over the place. You would report them to the Department of Labor and INS. The Better Business Bureau has nothing to do with employment matters as posted by the previous poster. Shut them down? Heck you can get some of these people in jail. |

I'm not sure exactly what is happening here. These H1Bs that are being hired as recruiters are not paid a base salary, or are only being paid commission, or the fees for their sponsorship are not being paid, or you believe their H1B status is questionable? Let's address these one at a time:
1) If they are receiving NO compensation, contact the department of labor at www.dol.gov; that will get you a link to the office in Maryland. Employees must be compensated for work they perform.
2) If they are being paid on a commission basis, this is legal (and probably normal for a recruiter function.)
3) If the company is not paying the fees to sponsor them for an H1B visa, that is legal. There is no requirement that the company pay the legal fees involved with sponsorship, although most companies do so.
4) if you are concerned about the validity of the H1B visas or the process that the company is using to hire these folks, visit www.uscis.gov to report your suspicions. This is the organization that deals with immigration issues. Realize that by doing so you may subject some of your coworkers to criminal proceedings and/or deportation.

I don't know what you are talking about, but I am so relieved to know that someone else has experienced this corruption besides myself. Try calling the better business burrow in the phone book that's the only advice I can give you, but I doubt it will do any good considering the government is involved, might even get you killed, dang this e-mail might get you killed.
