I have filed a complaint against my employer with the AGO for violating the meal break law.Does anyone know if they are fined where the money goes? The letter from Attorney General said they would forward any settlement but how do I know if I am entitled to anything.For example-say they found 30 incidents of me not being allowed a meal break-anyone know what kind of fine and what right I have to compensation?

The only thing you would receive is wages for time worked. If you did not get a meal break and worked through, then the employer owes you pay for all hours worked. If by working that extra time it takes you in to overtime then they would have to pay the wages as overtime. (if you work more than 8 hours in a single day or 40 in a week) You may get interest on the money not paid to you as well. |

Here in NY if you are fined it goes straight to the state.. :) The only thing an employee would get would be the wages owed, etc. I'm betting Mass is the same way.
I just went and pulled the regs up, the way I read it they would only be "fined" the amount of wages involved, so if it was an hour long break you were denied, you'd get an hour's worth of pay for each incident, up to one month's worth max. Nothing extraordinary, that's for sure.
