Maternity Rights - HELP?

I started with a Company on 9th April - 6 weeks into the job i found out i was 26 weeks pregnant.
I am now 35 weeks and due to finish next week.
had an appraisal last week and was told that i was account manager material (I am and account executive now) - Have just been told they have employed someone as an account manager - This means they have passed me up for promotion becuae of my pregnancy. is this legal?

Yep can see it from Company's POV - BUT did not know i was pregnant - Not getting anything from them at all - no benefits, pay etc...
Really feel for them but also i am very good at my job and i am worth about £400 per day to them - so yeah they are losing out - but i have to have the baby it's in there now and it needs an exit!!

I don't think so. If you had applied for the account manager's job then maybe, but it sounds as though the timing is just poor for you as the job came up and you were still a newbie and perhaps didn't even know the position was there to be applied for. I reckon you're future sounds good though! they clearly recognise your talents and that you have great potential, even though you've only been with them a short while.

PS don't listen to above advice! you could get a promotion then go off on maternity leave - it happened to my friend, she got promoted while pregnant and had to wait 9 months before she could go on the training programme and take up her new position. She's doing great now and so is her son. Some companies are forward thinking and recognise potential and don't want to let it go...

account manager is more responsible on daily basis then as of account executive, u ve been out of work , its for sure they had to replace you but what they did put u up which they had to otherwise u wud ve sued them for this, its natural for married and her right to becum mother , they cudn't fire you though promote you infact for no reason

Not necessarily. Think of yourself as an entrepreneur.

You are exchanging work for money and are most likely being paid well for your time and effort. Think about the company's perspective. You come on board, then announce you are pregnant after six weeks. Are you conveniently covered by the company's expensive medical benefits?

Who should bear the cost of your decision to have a baby? Should the company close down the line of business with the vacant Account Manager position until you are ready?

You are having a baby and that is great. Enjoy it, but take a little responsibility while you're at it.

Being told that you're account manager material is not an offer for a job, it's more an invitation to apply for it. If you were told that you had the potenital and didn;t follow it up off your own back and try to get yourself an interview then can't you understand why they would pass you up, pregnant or not? They do have to pay you maternity pay and hold your current job so take your time off with your little one and when you're ready to go back to work make sure YOU arrange an appoinment with the right people for the next job that comes up.

That was your supervisor's opinion that you are account manager material. As you are leaving anyway (you have got to be with an employer 2 YEARS before you can take maternity leave, that is the LAW), they would have to get someone else in to do the job anyway.

Well, if you still have your job and the position was one aimed to be created while you'll be on maternity leave, I'm fairly certain the company was well within their rights.

Also, being told you're account manager material is not an actual offer of the position it's being told that eventually you may be in the place to be offered that position. Obviously you're not at that place right now as you're going on Maternity leave.

Now if you'd been fired, or had been demoted when you told them you were pregnant you'd have an issue, but in your case I think you're just not able to fill the position right now, so it's someone else's.

It is very hard to prove that the company passed you up becasue you are pregnant. Also, it does not sound like you got an offer to become Account Manager, rather they told you that you were material to be one.

However, if you strongly feel you were discriminated against you can talk to someone in HR and file a written grievance. Keep in mind by doing this you could be opening up a can of worms that can seriously make things difficult for you when you return from maternity leave. Also, if you had a review at 34 weeks pregnant your employer obviously saw your belly and knew you were pregnant when they told you you were Account Manager material. Their rational could be you are Account Manager material just not at this point in time. Maybe they want you to get a little more experience, after all you have not even been with the company six months.

The bottom line here is that you have to proceed how you see fit.

yes it is legal and unfortunate... Been there myself... But if you were not formally offered or interviewed for the job then you were not even a candidate for the job...
