I live in Indiana and work for McDonalds. I broke my little toe and have a doctors excuse for 2 days off and one week of light duty. My boss told me we dont have light duty see you sat for full duty. is this legal if I cant get a shoe on and cant bend my foot

Your situation would not be covered under the ADA, so your boss actually could legally terminate your employment if you are unable to perform your job duties. The situation might be different if you broke your toe while at work and were receiving worker's compensation for the injury.
That said, I do not know any employer who would terminate you for not being able to perform your job for a week due to an injury. I would take loika61's advice about contacting your Human Resources department for advice. If you do not have a HR department accessible to you, you might try talking to the District Manager.

Your boss is wrong- You do NOT need to go to work if you have a note for light duty and you cannot do your normal job. Just call the Human Resource department and explain your situation to them and ask for advice (not to get your boss in trouble!) . Tell your boss that you cannot do full duty and could you reduce your hours? If not, you may have to sit out for a week but he cannot fire you legally! |
