Minimum Wage Legal Question?

So, minimum wage increased on January 1, 2009. Everyone here in Fl are all making the same amount because corporate cannot seem to get their act together and increase our rates to the equivalent of what we were making before. Even us specialists are making the same amount. My GM told me that we will not be getting compensated for all the work we are doing at minimum wage, and that we may not get our correct raises until minimum wage is increased again in July.
Is this legal? If not, whom do I contact?

Currently making UNDER minimum wage.
Legally, do they have to bring me to minimum wage?
AND Do they have to back pay me from Jan1?

If you are making at least minimum wage or over then corp does not have to give you a raise..

if you are now making under minimum wage they do have to back track and pay you that amount starting jan. 1st ....my work had to do this as well for me last year when in july minimum wage went up, they didnt change it for 2 months, but they did how ever have to go through and pay me that quarter for the hours i worked in the last 2 months.... if your talking about then just adjusting your pay because minimum wage went up, there is nothing they legally have to do, i know because i used to make 1.50 over minimum wage at that same job where they let me slip under minimum wage. it is the right thing for the company to do to adjust your income to the cost of living, but lets face it theres no law and most companys just dont care

There are exceptions to minimum wage law and your company may be taking advantage of that. That not withstanding, if you are making less than minimum wage and are legally entitled to at least that, then your company, if caught, would be responsible for back pay and potentially penalties and fines for wages not paid. If you have had this conversation with your GM, then it may be time to speak to HR. You should also read the workplace poster that should be posted called "Minimum Wage". If it's not the most recent one (2008) then talk to the division of employment in FL (the FL website was difficult and I couldn't find the actual agency to steer you to) to find out what the law says. You may have to file a formal complaint if the facts justify the situation in order to be paid what you are owed.

Unless you have a contract to the contrary (usually through a union) then it is perfectly legal. There is no law regulating how much a person has to be paid except for minimum wage laws. This applies no matter what position you hold, how long you've been there, how much seniority you have, or any other factors you can think of. Feel glad they have a plan to fix it even if you have to wait until July.

Are you saying that you use to make more then minimum wage, but since the minimum wage increased you are now only making minimum wage?
It's completely legal and in the HR world called "salary compression". When the minimum wage increases most companies don't increase the salary of employees making more than minimum wage, thus the salaries have been compressed together.

Its legal because they still clear the minimum wage. How ever I think they might be run by Communists. LOL

Yes, it perfectly legal. Raises are not guaranteed by law hence the minimum wage laws.
