Misdemeanor and fenoly the same thing on job application?
|
On a recent job application my friend filled out it asked Have you ever commited a fenoly in the last 7 years. She marked No becuase a few months ago she had stolen something for the first time and thats considered a misdemeanor. So is there a difference between the two? Was that the right thing to mark No?
HELP.

They are not the same thing. Technically speaking you can get a ticket and have a "misdemeanor" on your record. Felony implies that you committed a serious crime and/or served probation or jail time.
I looked up the technical legal definitions: Felony = 1) a crime sufficiently serious to be punishable by death or a term in state or federal prison, as distinguished from a misdemeanor which is only punishable by confinement to county or local jail and/or a fine. 2) a crime carrying a minimum term of one year or more in state prison, since a year or less can be served in county jail. However, a sentence upon conviction for a felony may sometimes be less than one year at the discretion of the judge and within limits set by statute.
The short answer to your question is if your friend did not have a "felony" on her record she answered correctly. And even so, depending on the state where you are from and the type of job she was applying for, the employer can't immediately disqualify her for the job anyway. |

There is a difference between the two. Misdemeanors are less severe criminal charges, such as drunk in public, most speeding violation if convicted, etc. Felonies are very severe criminal charges such as murder, rape, armed robbery, etc.
...your friend was okay marking no on her job application. |

when you steal something worth less than $100 it is a misdemeanor. if thats her case then yea she should have put "no" under felony |

Felony and misdemeanor are not the same thing. Felony is more serious. Misdemeanor is less serious. |

your friend was right - a felony is much more serious than a misdemenaor. a misdemeanor can't generally be used to prohibit employment. |

A misdemeanor is a lesser crime than a felony. A felony is more serious so she has marked it correctly. However, if she is asked she should not deny having stolen something. She should also make it very clear that she has learned her lesson and will never do it again. |

A felony is usually considered a crime punishable by more than a year in jail; a misdemeanor is something less. The two are different and your friend marked correctly. |

Do you mean felony? She lied when she said no because a few months ago was within that last 7 years. Stealing is a felony. |
