Misdemeanor... check yes or no on my job application, please help asap!!!?

ok, I have 3 minor consumption tickets in MN (underage drinking) which are all misdemeanors. My job application says:

During the past 5 yrs have you served a sentence in a jail or prison or been convicted of a misdemeanor or felony for which jail sentence could have been imposed? Yes or No.

**but then it says....***

You may answer No to this question if the conviction or criminal records thereof have been annulled, sealed, set aside, or purged, or if you have been pardoned pursuant to law.

I've just had to pay a fine for all of them, so do I check yes or no???

with that question I mark will talk about upon interview. So then I can let them know what happened and it might help to tell them you went to treatment for it.

If it hasn't been annulled, sealed, set aside, or purged and you haven't been pardoned, then you have to answer yes. If it is still anywhere on your record and they do a background check and find it, they won't hire you because you basically lied on your application. Just because you have a record and answer yes, doesn't mean they will automatically overlook you.

It looks like, even though you didn't go to jail, you were still convicted. So answer yes, it is worse to try and cover it up.

The question is whether a jail sentence could have been imposed for that particular offence? Check with your local court office - underage drinking may be a misdemeanour which does not carry a custodial sentence. If the only punishment under law for that offence is a fine, then you can truthfully answer "No" on your job app. Otherwise you have to say "Yes" and give details.
