My Mom is an LPN at a geriatric facility in my home state of Mississippi , she is employed At Will and injured her hip & back catching a patient that tried getting out of bed and almost fell ...there are almost no CNA's , and now she needs regular physical therapy and she hasnt filed for worker's comp just yet ( but did report & chart it ) and now the nurse manager is giving her a hard time at work and just looking for a reason to fire her because the manager has big control issues ..and now my mom's doctor has recommended physical therapy 3x's a wk and she has to work nights/graveyard and do PT during the day ..Don't they have to allow her time/ days to comply with her doctor's orders to get her PT done ? She have any possible legal rights , or remedies she can seek ? She has to sleep during the day to work nights and she has light duty now ..her PT is 2 hrs away and 2 hrs back home when she is then exspected to fullfil a full night shifts ..Any advice and suggestions or ideas at all ..who can she go to or get help from organizations , boards , etc . The nurse manager is just petty, pompass, and unfair woman ..my mom has been a nurse for over 15 yrs but never had issues until working at this hole ..( mom lives WAY OUT in the country ( so getting another job wouldnt be so easy option either . Thanx :)

Under Federal and any state law she is entitled to worker' s comp. Intimidating someone who is exercising that right is illegal. When you are injured on the job fill out a report on the spot. Get a lawyer.Under the worker's comp law she would be entitled to lost wages and all medical bills.File the claim NOW! |

She needs to file the workers comp claim pronto - get a lawyer who specializes in WC for protection and the best results. |

She should have filed a workers comp claim immediately, and should do so now. You don't say how long ago this happened, so it might be too late.
No they don't have to allow her time off to go to PT. She might be eligible for intermittent FMLA leave - they'd have to give her the time off if she is, and her doctor says she needs it. She might or might not be eligible for FMLA. And if she is, it's unpaid leave.
She should be able to schedule her PT early in the morning, and still have time to sleep for the rest of the day.

She should file Worker's comp and also disability with a doctor's written statement of her condition.
If she gets fired or laid off because she had to take time off for the doctor ordered physical therapy, she has a ground for lawsuit in "wrongful termination."
Main thing is for her to get well.
