A friend of mine owns a production company and record label. He asked me to be a talent scout. I agreed and he asked me to attend an event to scout talent. I found 2 talented individuals and referred them to him.
Now he is refusing to pay me. I have emails of him admitting he owes me. He promises to pay but I haven't seen any money yet.
I have been thinking of filing a suit in small claims court. But, I don't know what my rights are or how to go about it.
Please help.

It's very simple. Go to the court house (civil) and go to the clerk's desk (ask security and they will tell you where to go exactly) and merely state you wish to file a small claims. A form will be given to you. Fill it out and return to the clerk with fee (fee's vary in different State's.) In one section of the form it will ask you the amount you are suing for. Also include in the amount any court expenses (the fee you paid.) In the end of your complaint to the court end your statement with "I am asking for X amount of money due for work rendered on (dates) and court fees." Make sure to have all documents proving he stated he was going to pay you (the emails.) If after 30 days (could be different in your State) he still hasn't paid you would then go to your City Marshall's office and he/she will begin garnishing any wages they are earning or liquidate assets to pay the debt to you. |

Being in Human Resources, this issue comes up a lot. What you are dealing with here is a failure to pay for hours worked. Did you agree on a certain salary or method of payment? Were you be paid so much per day, so much per hour or so much per month?
The best thing to do would be to file what's called a "Wage Claim". Depending on your state, a wage claim is not a civil suit, but it is filed with your states department of labor and they investigate the matter, determine what if any money is owed to you, and he is required to pay you or face substantial fines. You don't need a lawyer as they usually assign an arbitrator to walk you through the process. I would keep the emails and contact your local department of labor as soon as possible. |

It's easy. Write him a letter, explaining clearly exactly what you think is fair. Demand in the letter to be paid by a certain date or you will file suit. Keep a copy of the letter, and proof of sending it to him by certified mail. In the letter you should mention that if you file suit, and win a judgement against him, it will hurt his credit for 7 years. If you want to file suit, go to your local courthouse and ask the clerk. They will give you a form to fill out or something like that.
Companies such as Lexis-Nexis send people to courthouses all over the USA to get information about lawsuits. They put negative information on the credit files of anyone who loses a lawsuit.
Small claims is easy. No lawyer needed. It's similar to Judge Judy etc. |

you need proof that he promised compensation (the emails would be good). proof that you did the work and proof that you did not intend on doing the work without compensation, and then an actual dollar amount that you feel is fitting for the work you have completed. it would also help if the talent you scouted had any amount of success to legitimize your job, but not entirely necessary. |

You need to keep the emails but also try to get him to admit to the dollar amount he agreed to pay. You can sue in small claims court but you must prove the dollar value owed along with that you have an agreement. |
