My previous employer is threatening to charge me for stealing money from a cash box I was in charge of, which is suppose to have $200.00 in it. They took $324 dollars out of my final paycheck, and when I let them know I would file would file a wage claim for these wages with the Devision of Labor Standards Enforcement office, they sent me an e-mail saying basically the would press charges against me for stealing (specifically calling me a theif). I did have my key to the safe that the box was stored in for a few weeks before sending it back to them, and they also did have the extra key they use to access the safe as well. I never signed any confession saying I stole from them. They don't have proof I stole anything other than what they say. My supervisor specifically told me to take the money from my box and pay it back whenever possible when I asked for an advance on my unused vaction time and was denied. One of my co-workers is witness to this because I was given a key for her cash box to share with her until the money in my box was replaced. She is a very honest person and I am sure she will sign a statement for this. Obviously, I did quit my job soon after for personal reasons, and have moved to a different city.
I think they are threatening me because they do not want me to report their illegal deductions. Also, because they might to pay me a waiting time penalty that I am filing for because my vacation pay was not on my final check, and it has taken them almost a month to send me another one for my unused vacation time.
Any advice will truly be appreciated here.

File your wage claim.
California Law is pretty strict. You have to receive any outstanding wages including accrued vacation balance on your last day of work if you have given them reasonable notice that you are quitting.
If you quit without notice you should have received your check witin 3 days.
Unless they fire you for cause and have you sign an admittance statement that clearly indicates that you admit to theft and to how much you stole, there is no way they can withhold any money.
Your story about being allowed to shorten the cash box for an advance won't be believed and the supervisor that gave you the OK to do this verbally will deny this. (If he doesn't he loses his job...).
So do yourself a favor and don't even bring this up.
Just file your wage claim and make sure that they also pay the penalty for not giving you your money on time. |

You quit and moved out of town, having taken money from the cash box, and didn't pay it back - and now YOU are complaining? They have every right to file charges against you. In CA they probably can't legally just take it out of your pay, but it sounds like you are opening a huge can of worms if you push this - you'll probably get your penalties on the withheld money, but will probably end up in jail for theft. Doesn't sound like a good tradeoff to me. |
