Money while signed off sick ?
Find answers to your legal question.

Money while signed off sick ?

My Husband has been told he will need a operation, and has been given the date next month.
In his pre-op assessment he was told he would be unable to go to work for about 4 - 6 Weeks after the op.
He's paid an Hourly Rate and has been told he's Not entitled to his normal wages while signed off sick (his boss told him this) ...
What do we do / entitled to / legally allowed
He is the main bread winner, and without sounding like I'm bragging etc, he earns very good money for his trade.
We have 3 Children, Rent, Bills etc. Oh, and Christmas coming up !!!!
Additional Details
He has not been employed by this company for overly long - approx 14 months, and no we don't have any savings (long story)
I do work, part time, and have asked for extra hours, although i will have to be my husbands carer as well, but due to current conditions extra hours are not available, and we have just been issued with an overtime ban... so that knocked that idea out.

some companies have Short term disability programs.....
is he allowed to use sick time, vacation time..etc?
my company allows the use of sick, then vacation and then short term dis. kicks in at one week of pay per year you have been with the company. it was a big help for me in 06 for a surgery. check with his HR dept regarding benefits.

if he has none of the available, maybe you could consider a 401K loan.

Sorry, but the company has no obligation to pay him for time he isn't working. If he has any kind of disability policy available, he could get some pay from that. Some states have disability coverage for employees.

He should file papers for FMLA leave while he's off - that at least gives him some job protection if he's eligible for FMLA.

Good luck to all of you - sounds like tough times ahead.

Assuming you are in the US...he is entitled to FMLA which is 12 weeks of unpaid job protection. There are two options you should look into first. Does he have short term disability through his work? If so he should make sure he received this. It may not be 100% of his pay but something is better then nothing. Second, does your state offer state disability? I know NY, NJ, an California do but there may be others. Your husband would probably see a tax on his paycheck if this is offered.

He should use whatever vacation/sick time he has left (if any)

If neither of the above is possibly you may need to look into getting a second job to make ends meet until he is able to go back to work. The company is not required to pay him his normal wages unless he has disability through them.

Best of luck to you...
