she is saying she doesnt have to give us the minum wage increase that just went up to 6.55 she is keeping the student workers all at 6.00 an hour is this leagal at all i know its unfair but is it legal?

Minimum wage is actually set by each state, although the federal gov't just raised the minimum that each state has to pay. Therefor, you need to find out what the law is in YOUR state, not just ask everyone here b/c you will get lots of various answers! |

Its called the "Youth Minimum Wage":
Federal Law States that if you are under 20yrs old and have been working for less than 90 days, she can pay you a minimum of $4.25/hr - the "Youth Minimum Wage". So in this economy, be happy that you are getting $6. After the 90days are up or if you turn 20 in the meantime, then she has to pay you the regular federal minimum of $6.55/hr.

So it probabaly means that you are getting laid off before the 90 days...sorry kid. |

By the federal Fair Labor Standards Act, it would be legal for your first 90 days assuming you are under age 20 - after that you have to be paid the $6.55 - see http://www.dol.gov/esa/whd/regs/compliance/posters/flsa.htm - bring up one of the posters and read it.
Many states have laws with stricter requirements than the federal - if your state does, then both federal and state laws must be complied with. |

ok...u seriously have to find out what the minimum wage is in YOUR CITY! California gets a lil confusing...for example...the min wage is $8.00 but if you were to live in Santa Monica (city is pretty darn expensive to live in) you would get paid $10 ONLY if you live AND work in Santa Monica. you should look at how much it is in YOUR AREA.
it should always be more than the MINIMUM WAGE! that's why it's called the BARE MINIMUM!!! it's what economists would refer to as price floor ABOVE the market price!!
Dont let employers boss u around...YOU HAVE RIGHTS TOO! you can even shut her business down if she has enough complaints against her for violation...RESEARCH AND LEARN!

It depends on the state of the minimum wage. I don't think it's legal, I'm not sure though. The only thing that changes if you're a student is your hours. There's a maximum for hours on students, but I doubt there's a lower wage for students. |
