My boss "asks" us to donate to United Way, we get a free vacation day ONLY if 100% of us do. Is this illegal?

I would think there has to be a law against basing company-wide employee benefits on the charitable donations of other employees, but I can't find anything. Thanks for the help.

No, it is not illegal. In fact it isn't even immoral. It shows CIVIC VIRTUE. You ought to try it, it might make you feel good.

An extra vacation day beyond the ones you usually get technically isn't actually a benefit - it's an *incentive* that your boss is providing in order to get you to volunteer. Nothing illegal about that. (If he was threatening to take away some vacation days if you didn't volunteer, then *that* might be illegal.)

It's not illegal. BENEFITS are at the option of the employer - they don't have to give you ANY vacation days, and if they do, they get to set the rules.

It's something he's giving you that you wouldn't otherwise get, so it's not illegal. If he was taking away a vacation day that was already in your contract if you didn't all donate, then that would be illegal.

Incentive is one thing, extortion is another.
Find out which is being done first before you take action. One is a very good thing, the other is very bad.

Using peer pressure to coerce can be construed as a type of hostile work environment, which is illegal.

Personally, I give to many different charities and the UW is not one of them-I stopped some time ago because I object to their practices personally and the thought of anyone trying to manipulate which charities I choose to give or not give to is scary to me. Where I work now they really try to guilt us into giving to the UW as well but I do not. I think it is sad that such practices are endorsed.

I worked for the Red Cross years ago. They donate to the United Way. We were "strongly encouraged" to donate
part of our paychecks. I consulted my Attorney, who put it this way. Either pay up or find another job. Believe me, I raised cane over the entire situation and continued working there for years. What I noticed though? Most of the "laws" to protect employees are very "skewed" in the Non-Profit world.
