My boss smokes inside our office is that legal? I am in California?

Smoking is in workplace is most definitely illegal in California. If your boss is the owner or president of the company, then report this directly to CalOsha, and he will learn of the law very quickly. If your boss is middle management in a larger company, simply go to HR and voice your concerns. If they do not respond to your complaint immediately, then go ahead and report to CalOsha (the fact that they do not respond to a complaint would levy even larger fines).

As far as lifting heavy materials - he is not obligated to help you, but the company is obligated to insure the weight is reasonable, and you have the training and ability to do this activity safely. If you get injured doing this activity, the company will be made very aware just how expensive the lack of prevention costs.

The fact that you do not know these things implies your company does not have the required legal notices posted in an employee area - yet another CalOsha violation.

While it is surprising the company has survived given these practices in this state, and the above direction will certainly penalize the company if they do not fall in line, you'll have to judge if you want to continue to work for a company that does not make employee welfare a priority.

Sounds like a boss who does not care about his workers.
As to smoking in the building, there are two things you need to find out first. Number one, The legality of smoking in the building in your local area, That is City, State, and County ordanances.
Number Two, The company policy on smoking in general, if he is in violation of the company policy, inform him of the policy. Then follow the rest of the policy as described. If no company policy, inform the person who is in charge of your boss, his boss.

If you job description does not involve lifting heavy items, then your boss is in the wrong. What if you hurt yourself while lifting it. get some professional advise and meanwhile, you should not have been lifting those boxes.

My boss smokes cigarettes in his office, but he does close the door. He's british (nothing wrong with that) but I think maybe he doesn't realize its illegal to smoke in the workplace.
But, if I were you, I would simply tell him the box is too heavy and could he please help.

WEll maybe he likes seeing you struggle... and regarding the cigars I think maybe you should go to human resources I'm pretty sure they will solve the issue...
