I don't see a breach of the non-compete clause here, but that doesn't mean the new business owners can tie you up and bog you down in court pushing it.
Is it worth not waiting a year? |

That's fine. If he has no hand in the business then it is not a breach of contract. |

It depends on what the non-compete says. It could say that a key employee of the business will not compete and that the employee was a signatory to that contract then you cannot service the same clients within a reasonable distance from the same geographical location. |
