My contract at work isn't being renewed? . . .?

i have been told that my contract at work isn't going to be renewed. i have worked there for a year and a half on 6 month contracts.
the reason that i was given is that they want to re advertise my job as a more "senior" role with a view to the candidate becoming a sales manager. Can they do this? the new role has just been advertised and it is exactly the same description as what i do now. do i have any rights here? is this unfair dismissal? if anyone knows about this could you please mention where on the internet i can find something about it?

I'm afriad it's the joys of contracting. They do not actually have to give any reason for not renewing your contract once it expires, that is one of the risks you run being a contractor rather than in a permanent role.

You should take expert advice from ACAS or the like. However, after 12 months they cannot just dismiss you 6 months contract or not. They have to make your position redundant. They can only do that if they do away with the job, or upgrade or downgrade it. Sounds like that's what they're trying to do. You can argue unfair dismissal on the basis of no change in the job.

If you have been working on 6 month rolling contracts and could have reasonably expected that it was going to be renewed then you have just been unfairly dismissed. The law says that rolling contracts cannot be used to replace permanent work unless it is clear that the fixed term is only to cover a specific period of work. As you have more than 12 months work here you should contact ACAS and consider taking them to tribunal.

However... your returns will be fairly minimal, tribunal awards are to compensate you for the loss of your rights (unless they are due to discrimination) and do not compensate for hurt feelings.

So you might get a month or two's wages and a little satisfaction - but it will probably cost you a decent reference in the future.

Have they not given you the opportunity to apply, unfortunatley there is not much you can do short term contracts are just that and they can terminate at the end of the contract or earlier as long as they give you the notice period as stated in the contract.

I'd talk to the cmpany's HR person they might be doing this unfairly. I hope you get it worked out.

(ANS) Sadly, these days nobody is indispensable & we now live in a world of insecure short term-ism & short term contracts. Gone are the days of ANY kind of job security.

**Your only as good as, what you can & do deliver for your company or organization.

**I think your taking a very defeatist attitude here, your assuming your job is dead buried & gone. If you have 1.5yrs experience why haven't you re-applied immediately for the re-advertised post?

**DON'T assume you know why the post is being re-advertised, there could be all sorts of reasons behind the scenes that you are not fully aware of.

**DON'T Give up!! reapply ASAP!! IMO. What have you too loose, you wont be any worse off if you try. Better the devil you know than the devil you don't & on that basis the company may still prefer you over someone else?
