My current employer wants another 2 weeks notice to leave even though i verbally told them in dec 08?

i went for an interview in dec 08 and was told i got the job pending ref, crb check etc.i told my current employer that i was leaving but hadn't got a start date and could take maybe 3 months. i finally recieved a start date for my new job but it was in 5 days time. my current employer wants me to change my start date and wants 2 weeks notice meaning i would miss start dat for new job. can they do this??

I think for the sake of a few days you could just quit. Speak to your new employer and they might be happy to put your start date back anyway.

Either that or i would drop some big hints about being a data protection risk. I went to the shops in my lunch break and bought a USB pen drive and left lying around! Obviously i didn't use it but it did sow the seeds of doubt in my managers mind and he let me go ealry.

If it is stated in your contract yes. But i know that you should not lose any entitlements if you leave sooner. I don't know what country you are from, but i literally resigned from a job on the spot last year even though i was supposed to give 4 weeks notice, i still got all my entitlements.
Don't let them pull that one over you.

No. It is there problem if they didn't find someone for your position over the last two months. Say I am very sorry, but I gave you notice two months ago and to change your start date would mean you lose out on this job opportunity. Unless you are under contract (which I find highly unlikely) you can leave yesterday.

Sorry but yes. You should have put it all in writing because now your employer can deny you ever told them and demand your two weeks. Sorry! But check your contract first, it all depends on how long you've been with your current employer first. The only way that you could start your new job on time is if you quit. But then you forfeit your last pay and they are not obligated to give you a reference.
