My daughter been out for a knee injury she got on her job since 6/08?

she going to have her second knee operation in a few weeks. her job told her if shes not back by 11/15 she will lose her job. what can she do to prevent this. just go back to work and do the best she can before the operation. willthis start the 6 month process all over again. any ides willhelp us thank you

A temporary injury can't count as a disability under the law. She has only 12 weeks of protected leave per year, so if she's already used up the 12 weeks they don't have to provide a job back to her. They've already done more than the law requires. |

If she is considered a temporary employee her options might be limited. Look at her employer's policies in their handbook if any. If they don't give her job back call the EEOC as that maybe considered discrimination based on disability. |
