If you have no proof then put it down to experience but keep an eye on them. |

As others posted. What's your question? Do you want to fire him/her for this? What proof did this second party give you? Pictures? Video with date and time? I have a staff of a little over 15 paralegals and they have certainly done the same. We all need a break and I have no problem with it as long as they don't abuse my kindness. Let it go. If it becomes a constant behavior then meet with him/her again and begin writing them up for absences. This way if you decide to terminate your a** is covered and he/she cant' scream it was a wrongful termination and file a bogus law suit against you guys. |

Did he have the sick day to use? Not sure you can do anything - legally anyway.
I've worked for managers who wanted me to pressure employees who they suspected were calling in "fake sick." Fact is, as long as they had the time to use, did not exceed the HR policy for unexcused absences, and did not call out for days where they absolutely had to be there or be gravely ill (first few days of the calendar month in my industry) I would not mention it. |

If you drink too much, you will develop a headache, nausea, irritiability, and a number of other symptoms that are not well-suited to the workplace. Unless your contract specifically states that hangovers are not regarded as suffficient reason not to work, you should accept that he was, indeed, sick - albeit as a result of wilful overindulgence.
If you're barring elective inability to work, you should also consider firing anyone who renders themselves incapable of working via any sort of hobby or sport. Broken your leg playing football? Tough. Your choice - hobble into work or off to the dole queue... |

If he has usually been a pretty good employee, a written warning or at the very least a strong verbal warning is in order. If he's a marginal employee, at the very least a strong written warning, or even firing him, makes sense. |

I think its safe to say we've all done that before. Yeah it sux for you as an employer but its not a HUGE deal. Maybe the guy just needed a day off. They are called mental health days, and if he had sick time to use or hasn't missed more than the alotted hours then just leave it along. Obviously if his attendance is an issue you will need to give him some sort of warning or write up but if thats not the case just go on about your day. |

If he is a good worker, I would give him a verbal warning that if he calls in sick again because of a hangover you will have to let him go. |

I agree with the third person.
Some people are unaware (or don't care) about the impact that their absence from work has on the rest of the organization. It can cause delays in production or service, create re-scheduling difficulties, and simply create extra work for their co-workers.
Illness and family emergencies are bound to strike the best employees, but when an employee simply fails to show up/calls in sick just to take a day off, that is unacceptable.
You are completely within your rights to set your employee down, tell them that they are now on warning, and that the next time this happens they will be looking for a new job.
In light of the economy and the number of good people who have been displaced through no fault of their own and are looking for work, you should have no trouble replacing someone who obviously takes their job for granted. |
