My employer has just told me I have to have Christmas Eve off unpaid and 2nd Jan off and take day from ....?

next years holiday entitlement. Is this legal? The firm is also shut Christmas Eve - New Years Day inclusive, which is paid holiday leave.
How can they force me to take 2 extra days off. I have worked for them for over a year.
Any advice or links to help me. UK only. Thanks

I have saved holiday for Christmas Day till New Years Day (inc) as this is part of my contract, I'm not questioning that, just the 2 days that I was expecting to work and now am not working!

Dictating when someone takes holiday is common - firms close and make their employees take 'compulsory' holiday on those days.

The exact same thing is happening at my husband's work but he is being forced to take 4 days over Christmas.

It is unfair - but unfortunately also legal.

However, I would question the unpaid part. You should have been told to 'save' holiday for that day if you were not required to work. Ask you HR dept if you have one or speak directly to your boss.

They can tell you when you have to take your paid holiday but if you were not told to save holiday for christmas closures then they can not make you take unpaid leave they are contractually obliged to provide you with work. Go to the CAB to get them to clarify your rights.

Go to the Citizens Advice Bureau; explain in detail the situation and get somethign in writing off your employer if you haven't already.

If it is to avoid redundancies, they can do it.

The CAB is very busy at the moment, people are in real trouble and you will not get an appointment before christmas.

I think you should ask your employer why this is happening and not take up their time with it. Your appointment will actually cost more to them than the money you're losing out on.
