Many people at my job are asking for their vacation time and paid time off. The employer is giving the time, just not paying them for it. This doesn't sound right. Is this legal in Florida? Many of them have worked hard for years, and now the company says it can't afford to pay them because of the economy.

Florida is a 'Right to work' State.
that pretty much means that whatever the company decides on the vacation policies and pay policies be it seperate or what, the company can change those policies at any time. This goes for hiring and lay offs and whatever the company can think of at the drop of a hat. They don't even have to notify their employees if they are closing for business. and it is all perfectly legal. go to myflorida.com |

Vacation, bonuses, annual and sick leave are all fringe benefits that employers have no obligation to pay out.

Check with the Florida Labor Office (800) 342-3450. This sounds illegal but that office should be able to tell you. |

If you have paid vacation coming, they should pay you....
If you are just taking time off, but have used up your vacation, for the year.. then they are ok... |

what does your employee handbook say? Does it say everyone has X days/weeks of paid vacation each year? - not sure what you can do - call your state dept of labor? |

Right or wrong is not the question here. Do you want to keep your job is the real question. In today's economy many companies are cutting back on their perks; paid vacations might be one. You really need to ask yourself do you want a paid vacation or do you want to keep a job.
At my job, a small firm, we all selected not to receive a bonus or paid vacation in hopes of keeping the doors open. |

Vacation pay is not a mandatory right, it a benefits that companies provided to their employees. Its not illegal for them to ask this. |

you can call the labor board, attorney and they will tell what I am going to, there is no law,regardless what these others think it is a gift by the emplyer and as such is not subject to any laws |

This is absolutely ILLEGAL!
If an employee has vacation time left, and wants to use all or portion of his/her accumulated vacation time AND the company approves it; then it's ILLEGAL for the company not to pay for vacations. Unless "Paid Vacations" is not a benefit offered every employee; which I doubt very much that's the case.
