My employer (soon to be ex) is pissing me off....how can i get my money?

Monday i discovered that one of my payroll checks (late to begin with) was returned NSF with fees.

On the same day , I put my two weeks notice in, becasue i found a much better job

my employer has not returned the money for the fundas and fees..which i need to pay bills

requested my resume upon departure

chastised me for only being with the company for a year (there are no IRAs , 401ks , Insurance,etc.)

I am angry , but i want to get my money in a professional manner, while still being able to use her as a reference becasue this was my first major job

I don't like the small claims court idea. You don't need a judgement....you need your money.

I would tell her that you appreciate the opportunity to work there and that you feel you have learned a lot and gained valuable work experience. Tell her that an opportunity has presented itself that you can't turn down and ask her when you should expect payment for the bounced check and your last check. If she beats around the bush, tell her you need the money to pay bills and you don't want the bounced check to end up causing you to have credit problems.

That's how I would handle it.

You can go to your state department of labor and tell them your paycheck bounced, or sue her in small claims court, but if she just doesn't have the money that won't get you your money.

You might end up out the money, if the business is going under. Be glad you found a new, better job so quickly. And good luck on the new job.

It's never a good sign when an employer bounces a payroll check. It might be a good idea to check with the Social Security Administration to make sure she has been baying your payroll taxes for you. Even if it says she has according to your W-2, I would check anyway. If you can afford to (it kind of sounds like you can't) wait it out until you start your new job and then call her demanding the money (as politely as possible). If she refuses, take her to small claims court. Given the situation, I wouldn't expect a raving review from her as a reference.

Does this company have a human resources division? If so, you can go to them, if not, there is always the better business bureau. If all else fails there is small claims court. Either way, I wouldn't count on them giving you a good reference.

Report the unpaid wages to the department of labor in your state. You can also file in court against the employer for the debt.

You can't be professional with an employer that is so unprofessional as to write bad payroll checks.

In as nice a way as possible, inform this person that either she gives you the money owed to you, including any bank fees, or you will file a claim against her in Small Claims Court. Then not only will she have to pay you, she will have to pay all of your Court fees. This is assuming you have a solid case and will win. This usually makes folks think twice before they withhold money due.
