My ex employer over paid me in wages for 3 months. Can they make me pay this back?

I was paid wages by my old employer for 3 months after I left my workplace. They have now sent me a solicitors letter saying I have to pay them back. I am not in a financial position to pay this back. What should I do?

Yes you have to pay them back the money that they paid you by mistake.
You can try to negotiate a repayment plan with them but if you are in arrears with other debts as well then I suggest you go and get advice from your local Citizens Advice Bureau.

Of course they can make you pay this back, u spent what wasn'y rightfully yours. i suggest u send them a polite letter back explaining you will pay the money back but can u come to some sort of arrangement i.e monthly payments. otherwise they will take you through the courts

Well, you probably shouldn't have spent the money in the first place.

I'd talk to Citizen's Advice, but I'm fairly certain they can take you to the small claims court for the money and you could end up with a county court judgement which will make any future credit difficult.

If I were you, I would talk to them, explain the situation and come up with a repayment plan that you can afford. As it was their fault you were overpaid they should be a bit helpful. But like I said, you should never have spent that money.

Call CAB, see what they say though.

why the hell did you spend that money. You knew you didn't work for them and yet you still spent the money. Your going to have to pay up, and next time just be honest. If someone ever over pays you should always tell you employer. Because if you worked for me I would if fired you over something like that.

Save, try and work out how to pay it back.... Legally you have to. You had no right to the money so they can ask for it back...

Well if you new the money was a mistake why did you spend it.....
Nothing is free in this world.
Come up with the money or talk to them about payment arrangements.
You do not need this coming back and bitting you on the butt.....
Morals are taught......

By law you have to pay this back, since you weren't actually entitled to the money. I suggest if you don't have the money, that you should contact the company and come to some arrangement with them. If you leave it, they could take you to court and get the money back themselves.

You need to offer to pay it back at a rate you can afford. Yes they made a mistake, but you were AWARE that it was a mistake, and therefore haven't got a leg to stand on. The only thing you can do is eat humble pie and come to some arrangement. Otherwise it'll get dragged throught the courts and you'll end up paying costs for it on top.

write to the them and make a payment plan like offer them to pay a certain amount a month even if its £10
they cant force u to pay more than u can afford
and is they take u to court the judge will be on your side as it was their mistake in the first place
