IF he's on the books and he doesn't receive any other compensation like tips or commission to bring his hourly wage to average over the minimum wage, then it's illegal.
If he DOES receive other types on compensation to supplement his wage, then no.
If he's OFF the books, then it's illegal in the sense that he's not reporting any income to the IRS, but he can pay him whatever he wants off the books cause it's illegal to begin with to do that.
P.S. It doesn't matter what state he's in because the federal minimum wage is currently more than 5.06 and has been for years, so a state can't set their minimum wage less than the federal wage. |
