My husband was just let go from his job, it was done unfairly what should we do?

My husband started a new job, no where did he sign that he agreed to no pay. He was not paid for the time he worked and was let go unfairly. It was for not taking a handbook home, which his manager never told him he MUST take it home. He was let go along with another woman, the manager didn't tell him he needed to leave and not come back it was a full-time employee. Does anyone know how we should take care of this?? Thank you in advance for any help you provide.

it is illegal to not pay someone for the time they have worked .call your local department of labor and file a complaint

First the good news - they are legally required to pay him for the time that he worked, even if it was just a few hours, or a few days. And even though it doesn't sound like he had enough time there to be eligible for unemployment, he might still be able to get it if he worked at some OTHER job for a significant part of the previous 6-12 months.

But the bad news - you feel it was unfair, and it might have been, that he was let go - but it isn't illegal, so there's no way for you to "take care of this", if you are in an "employment at will" state - and that's almost all states in the US. You don't say where you live - other countries' laws might be different.

i would call the manager/ boss. maybe the other worker lied. if not then look for a job. but i would threaten to sue and even contact a lawyer

the citizens advice could help him or an employment tribunal service go and see them and they will tell your husband if he has a case for unfair dismissal

It depends on how long he worked for the place. Most companies have policies in place that they can fire people without cause or notice for a predetermined period of time (it might be in that manual). Where I live it's 3 months. Of course, on the flip side, you can leave without notice in those 3 months. He is however, owed the money for the period of time he worked. Do you have a labor standards board? You should contact them. No reason to 'sue' right away as everyone always suggests.

Depending on the jurisdiction you are in yor husband could be considered an "at will" employee which means he can be terminated for any reason.

As for not being paid. Even if your husband had signed an agreement it would not be legal. You cannot waive your rights to be paid. He should contact the Labor Commissioner for your area and file a complaint. Be sure he adds up the hours he worked and the rate of pay he was to receive.

Many states also give what are called waiting time penalties which are equal to 8 hours of pay. Your husband would be eligible for the penalties if he was not paid, or if he was not given his final check on the day he was terminated.
